General Terms and Conditions of Trade

§1) Contract formation

The contract formation becomes operative with the order confirmation by finishing the order process. The conclusion of contract is individually regulated by the distance contract (§§ 312b ff. BGB), which is by act of law automatically integrated in the contract.

§2) Delivery and Services

The delivery and service of the company Percussion-Teufel Company Constituted Under Civil Law takes place excessive in virtue of the terms of business. Therefore the terms of business are valid also for future business relations, even then, when the terms of business are not explicit arranged again. With the consignment of the order by the acquiring party agrees the acquiring party with the mentioned terms.

§3) Expenses of the utilization of medium of communication

The consumer (purchaser) bears the usual and regular charges of the utilization of his medium of communication.

§4) Prices

All Prices are final prices, legal VAT is included.  Should the VAT increase after the conclusion of the contract, the seller is entitled, to pass the increased VAT to the buyer, which means, that the final price increases so far.

§5) Reservation of proprietary

The seller reserves the ownership of the delivered goods until full payment of the invoice. Is the ownership going astray according to the law, assigns the seller already his future right against the purchaser of the property in the amount of the outstanding depts. When attachment of the objects which are under reservation of proprietary, the buyer have to notify immediately the seller by written and have to inform the pawnee of the reservation of proprietary. The buyer is neither not entitled to alienate the objects which are delivered under reservation of proprietary nor to give away them, to pawn them or to assign for secure.

§6) Delivery charges

Delivery charges are included in price, there are no additional charges. Ruled of are deliveries to abroad. At deliveries to abroad, the buyer have to bear the flat rate of the delivery charges.

At restitution of an object the buyer have to bear the delivery charges.

§7) Place of fulfillment

Place of fulfillment is buyer`s place. Are both contracting parities fully-qualified traders is buyer`s place arranged by jurisdiction.

§8) Guarantee

The buyer has to notify possible defects of the delivered products immediately. As far as the delivered good show defects, a compensation delivery (delivery of a good free of defects) is offered by the seller, if rework (repairing) bears no relation to the value of the good.
